The Philippines:
An Underutilized Jurisdiction for Cross-Border Wealth Planning

Global Realtor 4a Cause · U.S. & PH Licensed · CPA · Realtor · PH Broker

Let’s talk shop

You already diversify everything else. Why not jurisdiction?

Investment, asset, currency, estate, and business diversification are second nature to you. Where assets are located affects how they are owned, taxed, inherited, and protected.

For the right client, that conversation should include the Philippines.

This guide is a discussion of planning concepts — not advice. Every strategy depends on the client’s facts and must be evaluated by licensed professionals in each jurisdiction.

1

Familiar concepts

You already advise on all of this — it also exists there

  • Asset protection & estate planning
  • Legacy & business succession
  • Retirement & trust planning
  • Corporate structures & life insurance
  • Tax planning & real estate investment

The laws differ. The regulations differ. But the planning conversation is surprisingly familiar. Internationally recognized insurers — Sun Life, Manulife and others — operate under Philippine regulation.

2

A true story

Why our founder moved — a family case study

Not a promise for everyone — an example of what’s possible.

  • Kept working remotely; spent winters on the beach while colleagues shoveled snow.
  • Qualified for the Foreign Earned Income Exclusion; chose a no-state-tax state.
  • Bought a 3,600 sq ft home with a 1,000 sq ft granny unit for the price of a small U.S. condo.
  • Cared for a father with Alzheimer’s — 24/7 live-in care — at a fraction of U.S. cost.

“I didn’t move to save money. I moved to gain options.”

3

Quality of life

Healthcare that surprised us

“I received one of the most comprehensive annual physicals of my life for about $200 out of pocket — broader testing than I’d routinely been offered in the U.S.”

Several physicians were licensed in both the U.S. and the Philippines and preferred practicing there: more personalized care, familiar technology, a fraction of the cost.

English is used throughout business, law, and medicine — the legal system traces to American roots.

4

Jurisdiction matters

An added layer of asset protection

A U.S. or Canadian judgment is not self-executing in the Philippines. Recognition is a separate Philippine judicial proceeding under Rule 39, Section 48.

The judgment is “presumptive evidence of a right” — not automatically conclusive — with recognized defenses (want of jurisdiction, notice, collusion, fraud, clear mistake). See Mijares v. Rañada, G.R. 139325 (2005).

That is not immunity. That is due process. That is jurisdiction.

5

Who can own

Your client may have more rights than a foreigner

  • Condos: any foreigner, up to 40% of a project.
  • Dual citizens (RA 9225): own land like any Filipino — no area limit.
  • Former natural-born Filipinos: up to 1,000 sqm urban residential (BP 185); more for business (RA 8179).
  • Also: 60/40 corporation, long-term lease (now up to 99 yrs), inheritance.

We structure ownership to comply — and tell your client plainly what applies.

6

The money leg

How funds move — safely, and never through you

Settlement uses a regulated payment stablecoin (post-GENIUS Act) via BSP-licensed partners and an attorney-managed escrow — delivery-versus-payment, fully KYC/AML compliant.

Neither you nor we ever take custody of the client’s money. A U.S. title company is available if preferred.

The smart contract settles the money leg only — title transfers at the Philippine Registry of Deeds.

7

For you

Compensation & compliance — and why it’s safe

A fully-disclosed, arm’s-length referral, structured to your desk. You are a connector, not a rep: no Philippine license, no funds, no transaction liability.

Built to the SEC Marketing Rule (promoter disclosure). A PH property bought without a U.S. mortgage is largely outside RESPA. If your desk says no, we can operate with no fee.

When your client succeeds, you’re the professional who made it possible.

8

Let’s talk shop.

The question isn’t whether every client should invest in the Philippines. They shouldn’t. The question is simpler: for the right client — should it be part of the conversation?

If the answer is “perhaps,” we’ll coordinate with you and a licensed Philippine team to get your client the best outcome — with every caveat handled.
