Here’s how U.S. and other foreign citizens can invest in PH land legally, even without citizenship — plus how we manage it for you.

The Philippines is one of the most attractive countries for international real estate investors seeking lifestyle, asset protection, and long-term value. With thousands of miles of coastline, a strong English-speaking population, and US-aligned legal systems, it’s no wonder expats and global entrepreneurs are looking to invest.

However, many foreigners believe they can’t own land in the Philippines — and that’s only partially true. Let’s clear it up:


✅ What Foreigners CAN Own in the Philippines

  • Condominium Units: Foreigners may own 1 or more condo units, with a maximum of up to 40% of the units in any one condominium project, as long as 60% is owned by Filipino citizens.
  • Buildings (Not Land): You can own the structure (house, resort, apartment, commercial building), but not the land it sits on — unless through specific structures.
  • Leased Land: You can lease land long-term (up to 50 years, renewable for 25) for personal or business use.
  • Through a Filipino Spouse: If married to a Filipino citizen, property can be held in the spouse’s name, but with contractual protections (e.g., legal wills, trust setups).
  • Through a Philippine Corporation: If 60% of shares of a Philippine corporation are owned by Philippine citizens, the corporation may own Philippine property with constitional protections, as long as it doesn’t violate the anti-dummy law

  • 🏛️ Legal Ownership Structures for Foreigners

    If you’re serious about investing, these structures can help you own or control property in a secure and compliant way:

    • Corporation (60/40): Create a Philippine corporation where at least 60% of shares are held by Filipinos and 40% by foreigners. This corporation can own land, commercial buildings, and agricultural assets.
    • Long-Term Lease with Option to Buy Improvements: Lease the land up to 25 years (usually renewable) and own the buildings on it. Many former US base sites are structured this way.
    • Trust Arrangements (for married couples): Hold land in a Filipino spouse’s name with legal structures to protect inheritance and control.
    • Business (s) (to run or M&A sell): Foreigners can 100% own, buy, run, build business in the Philippines and even build, construct buildings for that business. To protect the environment and national interests some industries like construction and educational institutions, restrict ownership to 40%. No ownership of media by foreigners is allowed. There are constitutional legal structures to protect your business interests or assets like any Filipino.
